WHAT IS (WIBA) INSURANCE POLICY?

WIBA Insurance in Kenya is a company that insures workers. Workers Injury Benefits Act is the abbreviation for Workers Injury Benefits Act. Parliament passed the Work Injury Benefits Act of 2007 to repeal Kenya’s Workmen Compensation Act, Cap. 236 of the rules.

It was the result of new labour legislation aimed at improving workers’ well-being. It is a legal obligation for companies and organizations to insure themselves against compensation for employee injuries.

The name denotes the root of the WIBA Insurance policy’s requirement. The Act went into force in December 2007 and has been questioned and revised many times since then. This is a policy that protects the insured’s workers against unintentional bodily harm, disablement, or death while on duty and engaged in the execution of the insured’s company &/or any project performed by the insured.

HOW I’M I AS THE EMPLOYER COVERED?

Under the Labor Laws regarding Health and Safety Act 2007, the WIBA Insurance policy protects you as an employer from legal liability. An Act of Parliament establishes the Work Injury Benefit. It covers you financially in the event of an employee’s work-related injury or occupational disease. It covers the costs of a funeral. It offers coverage for medical expenses.

HOW ARE THE EMPLOYEES COVERED BY WIBA?

WIBA insurance in Nairobi protects employee transportation to and from work, as well as medical costs incurred as a result of an accident or illness.

This is a hybrid of the Workmen’s Compensation Act (WCA) and Community Personal Accident (GPA) coverage, structured to provide an employer with a one-stop-shop for employee benefits. It tackles both on-the-job and off-the-job threats.

Our WIBA policy protects employees of the insured when on duty and engaged in the conduct of the insured’s company and/or any project performed by the insured from unintentional bodily injury, disablement, or death, as well as an occupational illness.

WHAT ARE THE WIBA INSURANCE POLICY EXCLUSIONS IN KENYA?

The insurance provider will not pay you if any of the following occurs:

  • WIBA Insurance Kenya will not pay the workers if an accident occurs that is not caused by their wrongdoing and does not result in permanent disability or death.
  • Accidental death or work-related accidents that occur outside of the workers’ regular working hours are not covered by the Work Injury Benefits Act.
  • Some work-related accidents or occupational disorders contracted outside of Kenya are not covered.
  • Any liabilities resulting from any court proceedings will not be covered by WIBA Insurance.
  • It excludes any acts of terrorism or political activity.
  • It does not have coverage for the employee while he is not employed by the company.

WHAT ARE THE DOCUMENTS NEEDED TO MAKE A WIBA CLAIM IN KENYA?

Before filing WIBA Insurance Claim, the following documents are needed;

  • Completely filled out Parts 1&2 of Dosh are obtained from the Ministry of Labor’s offices.
  • Initial medical bills from the hospital where you were treated
  • If the company requests it, a medical opinion/medical report signed by the doctor is requested.
  • Employer’s sheets should be thrown away.
  • The claimant’s appointment letter from the employer.
  • A report from the health and safety committee of the insured.
  • Documents related to a death allegation
  • The document is only for reference.
  • Death certificates, certified copy
  • In the event of a fatal accident, an identity card is required.
  • In the event of a road accident, the police will prepare an abstract report.
  • The immediate supervisor’s written, signed, and sworn statement
HOW TO FILE WIBA INSURANCE CLAIM & DOCUMENTS REQUIRED?

Here are the steps to take when filing a WIBA claim:

Step 1: You must notify the director of occupational health and safety of any fatal work-related accidents or diseases within 24 hours. You must register non-fatal work-related accidents and occupational diseases within seven days.

Step 2: Complete Part 1 of the Labor Form Dosh.

Step 3: Verify that the attending physician completes Dosh Part 2

Step 4: After completing sections 1&2 of the Dosh forms, send them to the Labor Office for evaluation. After the evaluation, the Labor Office fills out the WIBA form.

Step 5: Receive a written statement from the complainant, an eyewitness, and the claimant’s supervisor.

Step 6: As soon as an accident happens, contact the insurer and submit a blank claim form to fill out.

Step 7: Fill out the claim form and send it back to your insurance company.

Phase 8: The final step is for the insurance company to pay money to the applicant or beneficiaries from their bank accounts. The legal procedure starts if the complainant or the beneficiaries do not accept the bid.
